​酒類販売に関する法令遵守事項

酒類の販売方法等について次の事項を満たしていること


(1) 特定商取引に関する法律の消費者保護関係規定に準拠していること

 イ カタログ等(インターネット等によるものを含む。以下同じ。)に次の事項が表示されていること

(イ) 商品の販売価格(販売価格に商品の送料が含まれない場合には、販売価格及び商品の送料)
(ロ) 商品の代金の支払の時期及び方法
(ハ) 商品の引渡時期
(ニ) 商品の売買契約に係る申込みの期間に関する定めがあるときは、その旨及びその内容
(ホ) 商品の売買契約の申込みの撤回又は解除に関する事項(その売買契約に係る返品特約がある場合はその内容を含む。)
(ヘ) 販売業者の氏名又は名称、住所及び電話番号
(ト) 法人の場合、インターネット等によるときは、販売業者の代表者又は通信販売に関する業務の責任者の氏名
(チ) 販売業者が外国法人又は外国に住所を有する個人であって、国内に事務所等を有する場合には、当該事務所等の所在場所及び電話番号
(リ) 上記(イ)以外に購入者が負担すべき金銭があるときは、その内容及びその額
(ヌ) 引き渡された商品が種類又は品質に関して契約の内容に適合しない場合の販売業者の責任についての定めがあるときは、その内容
(ル) 商品の売買契約を2回以上継続して締結する必要があるときは、その旨及び金額、契約期間その他の販売条件
(ヲ) (リ)、(ヌ)、(ル)に掲げるもののほか、商品の販売数量の制限その他の商品の販売条件があるときは、その内容
(ワ) 請求により交付する書面又は提供する電磁的記録が有料のときは、その額
(カ) 電子メールで広告するときは、販売業者の電子メールアドレス

 ロ 商品の引渡しをする前に、商品の代金の全部又は一部を受領する場合は、申込みを承諾する旨の通知をすることとしていること
 

(2) 二十歳未満の者の飲酒防止に関する表示基準に基づき、カタログ等(インターネット等によるものを含む。)に次の事項が表示されていること
 イ 「20歳未満の者の飲酒は法律で禁止されている」又は「20歳未満の者に対しては酒類を販売しない」旨(カタログ等)

 ロ 申込者の年齢記載欄を設けた上で、その近接する場所に「20歳未満の者の飲酒は法律で禁止されている」又は「20歳未満の者に対しては酒類を販売しない」旨(申込書等)(インターネット等により申込みを受ける場合には申込みに関する画面)


 ハ 「20歳未満の者の飲酒は法律で禁止されている」旨(納品書等)
 (インターネット等による通知を含む。)


 ニ 上記イからハについて、10ポイントの活字(インターネット等による場合には酒類の価格表示に使用している文字)以上の大きさの統一のとれた日本文字で明瞭に表示していること


(3) 酒類業組合法に基づき、カタログ等(インターネット等によるものを含む。)の見やすい場所に次の①から⑤を記載した標識を表示していること

① 販売場の名称及び所在地 「標識」のイメージ
② 販売管理者の氏名
③ 酒類販売管理研修受講年月日
④ 次回研修の受講期限(③の3年後の前日)
⑤ 研修実施団体名


(注)「確認」欄には、作成した添付書類について、それぞれの確認事項及び添付を確認し、○ 印( 提出しなくても良いもの又は該当がないものについては、確認欄に斜線を引いてください。) を記載してください。
